EXP collects personal information in order to provide you with a safe, smooth, efficient, and customized experience. We only collect personal information about you that we consider necessary for achieving this purpose.

You can browse the Site without telling us who you are or revealing any personal information about yourself. During your visit, EXP automatically tracks certain information based upon your behavior on the Site. We use this information to do internal research on our users' interests, and behavior to better understand, protect and serve you. This information may include the URL that you just came from (whether the URL is on the Site or not), your computer browser information, your computer operating system and your IP address.

EXP uses data collection devices such as "cookies" on certain pages of the Sites to help analyze our web page flow, measure promotional effectiveness, and promote trust and safety. "Cookies" are small files placed on your hard drive. We offer certain features that are only available through the use of a cookie. If you choose to use EXP' services, we require you to provide contact and identity information, billing information, shipping information, Federal Registration information and other personal information as indicated on the forms throughout the Sites.

EXP uses your personal information to facilitate the services you request. We use your personal information in the file we maintain about you and other information we obtain from your current and past activities on the Sites to: resolve disputes; troubleshoot problems; help promote security; inform you about online and offline offers, products, services, and updates; customize your experience; detect and protect against error, fraud and other criminal activity; enforce our User Agreement; and as otherwise described to you at the time of collection.

You agree that EXP may use your personal information to contact you and deliver information to you that, in some cases, are targeted to your interests, such as marketing literature, product offerings, and communications relevant to your use of the Sites. If you do not wish to receive these communications, you can "opt out" of the receipt of follow up communications on the email notification or make changes to your notification preferences at any time as detailed in Section 7.

EXP does not sell, rent, trade or disclose any of your personal information to third parties for their marketing purposes without your explicit consent.

Notwithstanding the above, EXP reserves the right to release personal information when we believe that the law requires us to do so or when we believe it is necessary to protect and/or enforce the rights, property interests, or safety of EXP, our customers and others.

EXP is committed to taking reasonable steps to protect the personal information that you provide. Your information is stored on EXP' servers located in Fremont, California, United States of America. We use procedural and technical safeguards to protect your personal information, including encryption, "firewalls" and Secure Socket Layers, against loss or theft as well as unauthorized access and disclosure.

However, "perfect security" does not exist on the Internet. EXP cannot ensure that all of your private communications and other personal information will never be disclosed in ways not otherwise described in this Privacy Policy. By way of example (without limiting the foregoing), third parties may unlawfully intercept or access transmissions or private communications. Therefore, although we use industry standard practices to protect your personal information, we do not promise, and you should not expect, that your personal information or private communications will always remain private.

6. Control of Your Password.

You are responsible for all actions taken with your User ID and password, including changes or access to your account. Therefore we recommend that you do not disclose your EXP Customer Portal password to any third parties. If you choose to share your User ID and password or your personal information with third parties, you are responsible for all actions taken with your account. If you lose control of your password, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf.

If your password has been compromised for any reason, you should immediately change your password as detailed in Section 7.

7. Accessing, Reviewing and Changing Your Personal Information.

EXP offers you the ability to automatically review and change the information you submit to us by going the preferences and setup section in User Preference on EXP' customer web sites and entering in the new information yourself. You must promptly update your personal information if it changes or is inaccurate.

If you believe your password or personal information has been compromised and you can not access your account via the internet, call 1-800-350-0397 or email customerservice@expworld.com.

Upon your request, EXP will deactivate your account, contact information, billing information, shipping information, and financial information from our active databases. To make this request, email customerservice@expworld.com. Such information will be deactivated as soon as reasonably possible based on your account activity and in accordance with our deactivation policy and applicable law. EXP will retain in our files some personal information to prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our User Agreement and comply with legal requirements as is permitted by law.

8. Governing Law and Jurisdiction

This Privacy Policy shall in all respects be governed by, subject to, enforced and construed in accordance with the laws of the State of California including all matters of construction, validity, performance and enforcement. The parties agree that the exclusive jurisdiction and venue of any action between the parties arising out of, or in any way connected with the provisions of this Privacy Policy, the subject matter hereof, the parties mutual rights and obligations arising heretofore or hereafter or the performance of any of the terms and conditions hereof by either of the parties hereto shall be the Superior Court of California for the County of Alameda and the United States District Court for the Northern District of California, as applicable, and each of the parties hereby submits itself to the exclusive jurisdiction and venue of such courts for purposes of any such action or proceeding.
